Navigating the National Interest Waiver in 2025: Rising Filings, Lower Approvals, and Stricter Scrutiny.
The National Interest Waiver (NIW) has long offered a valuable pathway for highly skilled professionals to obtain permanent residence in the United States without employer sponsorship. But recent USCIS trends reveal that the NIW landscape is changing rapidly and not necessarily in favor of petitioners.
Since the fiscal year 2018, NIW filings have skyrocketed, driven in part by increasing interest from self-petitioners and highly skilled professionals around the world. However, this spike in demand has been met with declining approval rates. From 2018 through 2023, approval rates consistently exceeded 90%. In stark contrast, 2024 saw approvals plunge to just 43%, representing a significant shift in adjudication trends.1
This backlog is reflected in the percentage of cases still awaiting adjudication. In 2018, only 3.36% of cases remained pending. By 2024, that number had ballooned to 38.98%, indicating slower processing and heavier scrutiny.2
With long delays in regular adjudication, premium processing is an attractive option for many NIW applicants, but it comes with tradeoffs: Faster I-140 adjudication (currently 45 calendar days) versus higher fees, increased risk of Requests for Evidence (RFE) or quick denials if the case is not thoroughly prepared, and limited impact on priority date retention, especially for countries with visa backlogs. For these reasons, premium processing is best for well-documented, strong cases.
Moreover, appeals to the Administrative Appeals Office (AAO) have surged—but with very low sustain rates, showing that USCIS is largely upholding its denials. For many applicants, a denied NIW is proving difficult to overturn.
Recent adjudications and updated USCIS guidance suggest an increased scrutiny on degree equivalencies and professional experience, particularly in STEM fields.
The takeaway is clear: NIW petitions face an increasingly uphill battle. With lower approval rates, rising backlogs, and stricter adjudication standards, it’s more important than ever to present a cohesive, well-documented, and nationally relevant petition.
