Employment Based Immigration: First Preference

An individual may be eligible for an employment-based, first-preference visa if he/she has an extraordinary ability, is an outstanding educator/academic or is a multinational executive or manager. Each specific occupational category has particular requirements that must be met. Employers must sponsor their employee by filing USCIS Form I-140, Petition for Alien Worker in cases involving Outstanding Professors/Researchers or Managers/Executives.

An individual may file USCIS Form I-140 independently in cases of Extraordinary Ability.
